Terms of Service

Welcome to Creators Palace HQ. By using our platform, you agree to these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By accessing or using Creators Palace HQ, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.
2. User Accounts
To use certain features of the platform, you must register for an account. You agree to:
- Provide accurate and complete information
- Provide a valid phone number during registration
- Maintain the security of your account credentials
- Promptly update any changes to your information
- Accept responsibility for all activities under your account
Your phone number is used for account verification and password reset. You may operate as both a Client and Creator on the platform. Each role has specific responsibilities outlined in these terms.
3. Creator Services
Creators offering services on our platform agree to:
- Provide services as described in their listings
- Communicate professionally with clients
- Deliver work within agreed timeframes
- Comply with all applicable laws and regulations
- Maintain appropriate licenses and permissions for their work
- Set accurate pricing for services and any optional add-ons
Creators are independent contractors and not employees of Creators Palace HQ.
Service Add-Ons: Creators may offer optional add-on extras for their services (e.g., "Drone footage", "Rush delivery"). Add-on pricing is set by the creator and displayed to clients during booking. Selected add-ons are included in the total booking amount and subject to the same payment and escrow terms.
4. Client Responsibilities
Clients using our platform agree to:
- Provide clear requirements for requested services
- Make timely payments for booked services
- Communicate respectfully with creators
- Review and approve/request revisions within reasonable timeframes
- Respect creators' intellectual property rights
5. Payments
All payments are processed securely through our payment partner, Stripe.
- Payments are held in escrow until service is completed
- Funds are automatically released when both deposit and final payments are held and the client approves the delivered work
- The total booking amount includes the base service price plus any selected add-ons
- Creators are responsible for any taxes on their earnings
- Refunds are subject to our cancellation policy (see Section 9)
Processing Fees: A Stripe processing fee (2.9% + $0.30) is applied to each payment and is paid by the client. This fee is displayed as a separate line item during checkout. Processing fees are non-refundable, even if the booking payment itself is refunded.
6. Deposits and Booking
In-Person Services (Photography, Videography):
Clients pay a 50% deposit on-platform. The remaining 50% is handled directly between the client and creator off-platform:
- The 50% deposit is held in escrow until the client confirms the service was completed
- On confirmation, the deposit is released to the creator
- The remaining 50% is settled off-platform (cash, Venmo, etc.) between client and creator
- No file delivery, watermarks, or previews are required for in-person services
- The platform fee for in-person services is 10% of the deposit payment only
- No refunds after service confirmation
Digital Services (Editing, Graphic Design):
- A 50% deposit is required at the time of booking
- The remaining 50% is due after the creator delivers their work
- Creators Palace HQ retains a 5% platform fee on each payment (deposit and final)
- Clients must pay the remaining 50% before viewing watermarked previews
General:
- The total booking amount includes the base service price plus any selected add-ons
- All payments are held in escrow until conditions are met
- Creators have 48 hours to accept or decline a booking request. If the creator does not respond within 48 hours, the booking is automatically cancelled and any deposit is refunded to the client
Payout Timing:
After a payment is released from escrow, it is transferred to the creator's Stripe Connect account. Stripe then sends the funds to the creator's linked bank account:
- Standard payouts: 2 business days after the transfer is created
- First payout: New Stripe accounts may take 7-14 days while Stripe verifies the account
- Bank processing: An additional 1-2 business days for the bank to make funds available
Total time from release to bank account is typically 2-4 business days for established accounts.
7. Payout Models
In-Person Services (Photography, Videography):
- Client pays a 50% deposit on-platform at checkout
- The remaining 50% is handled off-platform between client and creator
- After the service date, the client confirms the service was completed (or it auto-confirms after 24 hours)
- The deposit releases to the creator immediately on confirmation
- No file delivery, watermarks, or previews are required
- No refunds after service confirmation
Digital Services (Editing, Graphic Design):
- Client pays a 50% deposit at checkout
- Both the deposit and final payment are held in escrow until the client approves the deliverables
- Both payments release together upon approval
- The creator uploads work within their set delivery timeframe
8. Delivery Deadlines
Digital Services:
- Creators set an estimated delivery time on each service (e.g., 3, 7, 14, or 30 days)
- After a service is confirmed, the creator must upload deliverables within this timeframe
- Failure to deliver on time results in a delivery strike (see Section 10)
- Clients are notified if the creator misses a delivery deadline
In-Person Services:
- No delivery deadlines apply — in-person services do not require file delivery
- Creators may optionally share files via chat
9. Cancellation Policy
Each creator sets their own cancellation policy. Available options include:
- No Refund — The deposit is non-refundable regardless of when the client cancels
- 24-hour window — Client must cancel at least 24 hours before the booking
- 48-hour window — Client must cancel at least 48 hours before the booking
- 72-hour window — Client must cancel at least 72 hours before the booking
The creator's cancellation policy is displayed during checkout before payment.
Client Cancellations:
- If the creator has a No Refund policy: Deposit is forfeited on any cancellation
- Cancelling OUTSIDE the cancellation window: Full deposit refund
- Cancelling WITHIN the cancellation window: Deposit is forfeited to the creator
Creator Cancellations:
- If a creator cancels, the client always receives a full deposit refund
- Repeated cancellations by creators may result in account review
10. Creator Strike Policy
Creators who miss delivery deadlines receive strikes:
- Strike 1: Warning notification
- Strike 2: Warning + 7-day restriction from accepting new bookings
- Strike 3: Account suspension and removal from the platform
11. Account Suspension & Bans
- Suspended accounts cannot log in, accept bookings, or appear in search results
- When an account is suspended, the phone number and email are added to a blocklist
- Banned users cannot create new accounts using the same phone number or email
- All pending bookings are cancelled and clients receive full refunds when a creator is suspended
- Suspension may result from 3 delivery strikes or violation of these terms
12. Dispute Resolution
If a client is not satisfied with delivered work:
- The client may dispute the delivery and request one revision
- The creator then has the opportunity to revise and re-upload their work
- After revision, the client may approve the work or escalate to platform review
- Escalated disputes are reviewed by Creators Palace HQ, and a final decision is made by the platform
- Each booking is limited to one dispute/revision cycle
Dispute Limits: Users who accumulate 3 or more disputes filed against them may have their account suspended pending review. Users with 2 or more disputes will be flagged for platform review.
Fraudulent Disputes: Filing false or frivolous disputes may result in account suspension. Disputes should only be filed for legitimate service quality concerns.
Self-Dealing Prohibition: Creating multiple accounts to transact with yourself (e.g., booking your own services via another account) is strictly prohibited and will result in a permanent ban of all associated accounts.
13. File Delivery and Watermarking
Creators deliver files (photos, videos, etc.) to clients through the platform:
- Delivered files are watermarked in preview until the client completes full payment
- Watermarks are applied to both images and videos to protect the creator's work
- Once both the deposit and final payment are completed and escrow is released, clients can download unwatermarked files to their device
- Clients may save files to their camera roll or share them via the platform's download feature
Creators are responsible for uploading only content they have the right to distribute. Clients may not redistribute, resell, or claim ownership of delivered files beyond the agreed usage rights.
14. Portfolio
Creators may upload photos and videos to their portfolio to showcase their work:
- Portfolio content must be original work or content you have permission to display
- Portfolio content is publicly visible to all platform users
- Creators are responsible for ensuring portfolio content does not violate any laws or third-party rights
- Creators Palace HQ reserves the right to remove portfolio content that violates these terms
15. Profile Boosts
Creators may purchase a Profile Boost to increase their visibility in search results:
- Boosts are available in tiered durations: 1 week, 2 weeks, or 4 weeks
- Pricing varies by tier and is displayed at the time of purchase
- A processing fee applies to each boost purchase
- Boosted profiles appear higher in search results and are marked as "Promoted"
- Boost purchases are non-refundable once activated
- Boosts do not guarantee bookings or client engagement
- Creators Palace HQ reserves the right to modify boost pricing, tiers, and duration
16. Creator Badges & Levels
Creators may earn badges and progress through levels based on their activity and performance:
Levels: Creators advance through five tiers — New Creator, Rising Star, Established, Top Creator, and Elite — based on total completed bookings. Your level is displayed on your profile and in search results.
Badges: Badges are awarded for milestones such as completing your first booking, maintaining a 5-star rating, fast response times, reaching veteran status, being in the top-rated creators, or trending with high recent activity.
- Badges are awarded automatically by the system
- Some badges (e.g., Fast Responder, Trending, Top Rated) can be removed if conditions are no longer met
- Creators are notified when they earn a new badge or level up
- Badges and levels are informational and do not create any contractual obligations
- Creators Palace HQ reserves the right to modify badge criteria and level thresholds
17. Favorites
Clients may save creators to their Favorites list for easy access:
- Favorites are private and visible only to the client who saved them
- Creators are not notified when they are added to or removed from a client's Favorites
- Favorites can be managed from the Favorites tab or from creator profile and search screens
18. Intellectual Property
Unless otherwise agreed:
- Creators retain ownership of their original work
- Clients receive a license to use delivered work for agreed purposes
- Neither party may infringe on third-party intellectual property
- Portfolio rights should be discussed before booking
- Delivered files remain the intellectual property of the creator unless a transfer of rights is explicitly agreed upon
19. Prohibited Conduct
Users may not:
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent content
- Circumvent platform fees through off-platform transactions
- Use the platform for illegal or unauthorized purposes
- Attempt to gain unauthorized access to our systems
20. Fraud Policy & Arbitration
Self-Dealing: Booking your own services through another account, or coordinating with others to create fraudulent transactions, is prohibited. Accounts involved in self-dealing will be permanently banned and any associated payouts withheld.
Fraud Investigation: Accounts suspected of fraudulent activity will be flagged and may be suspended pending investigation. The platform reserves the right to withhold payouts during an active fraud investigation.
Arbitration: All disputes that cannot be resolved through the platform's dispute resolution process will be settled through binding arbitration in accordance with applicable law. By using the platform, users waive the right to participate in class action lawsuits against Creators Palace HQ.
Liability Cap: The platform's liability for any dispute is limited to the total amount of the transaction in question.
21. Limitation of Liability
Creators Palace HQ provides a platform connecting creators and clients. We are not responsible for:
- The quality of services provided by creators
- Disputes between users
- Any damages arising from use of the platform
- Third-party content or services
Our liability is limited to the maximum extent permitted by law.
22. Termination
We may terminate or suspend your account at any time for violations of these terms. You may also close your account at any time by contacting support. Upon termination, pending transactions will be handled according to our policies.
23. Changes to Terms
We may update these terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the new terms.
